Terms of Service

Please read these terms carefully before using MCP Analytics services

These Terms of Service ("Terms") govern your use of the website at mcpanalytics.ai and the related services at app.mcpanalytics.ai, account.mcpanalytics.ai, and api.mcpanalytics.ai (collectively, the "Services"), operated by PeopleDrivenAI LLC ("MCP Analytics", "we", "us"). By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your Account

You are responsible for activity under your account, including keeping your credentials confidential. Notify us promptly at [email protected] of any suspected unauthorized use.

3. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes.

4. Acceptable Use

You agree not to:

  • Upload content you do not have the right to use, or that violates any law or third-party right;
  • Upload data subject to HIPAA, PCI-DSS, or similar regulated regimes unless you have a written agreement with us authorizing such use;
  • Reverse engineer, scrape, or attempt to extract source code from the Services;
  • Interfere with the operation of the Services, probe for vulnerabilities without prior written authorization, or attempt to access another user's data;
  • Resell or sublicense the Services without our written consent.

5. Customer Content

You retain all rights in datasets, queries, and outputs you submit ("Customer Content"). You grant us a worldwide, non-exclusive license to host, process, and transmit Customer Content solely to operate the Services for you. We do not use Customer Content to train AI models.

6. Fees and Payment

Paid plans and credits are billed in advance via Stripe. Fees are non-refundable except where required by law. Subscriptions auto-renew until canceled; you may cancel at any time via the account page, and cancellation takes effect at the end of the current billing period. Prices may change with at least 30 days' notice for existing customers.

7. AI-Generated Insights

The Services include LLM-generated narrative insights via Anthropic's Claude. AI output may be inaccurate or incomplete. You are responsible for reviewing AI-generated content before relying on it for decisions. The Services are not a substitute for professional advice (legal, medical, financial, etc.).

8. Third-Party Services

The Services integrate with third-party providers (e.g. Stripe, Auth0, Google Analytics, Anthropic). Your use of those providers is also governed by their own terms; we are not responsible for their acts or omissions.

9. Intellectual Property

We retain all rights in the Services, including software, designs, documentation, and the MCP Analytics name and logo. These Terms do not transfer any of our intellectual property to you.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100). WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES.

12. Indemnification

You agree to indemnify and hold harmless PeopleDrivenAI LLC, its officers, employees, and agents from any third-party claim arising out of your Customer Content or your breach of these Terms.

13. Termination

You may stop using the Services at any time and delete your account via the account page. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Services in a way that creates risk for us or other users. On termination, your right to access the Services ends; sections that by their nature should survive (5, 6, 9-13, 15) will survive.

14. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. Material changes will be posted here with an updated Effective Date. Continued use after a change constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
